Lessee expressly covenants that <br />at no time during the term of this Agreement shall Lessee use or <br />permit to be used any part of the Premises, ar the building in <br />which it is located, for a pornographic adult book store, massage <br />or wrestling parlor, topless or bottomless bar or Roman spa. <br />Furthermore, Lessee covenants not to use nor permit to be used any <br />part of the Premises for any purpose prohibited by state, county, <br />municipal or federal law, including regulations promulgated by the <br />North Carolina Board of Alcoholic Beverage Control. <br />(a) inducement. Lessee expressly agrees and acknowledges <br />that the aforementioned covenants are inducements for Lessor to <br />contract, are of the essence., and shall be liberally construed in <br />Lessor's favor. <br />(d) Remedy. Lessee expressly agrees and covenants that <br />should Lessee breach any of the covenants enumerated above, Lessor <br />shall have, at its option, (1) the right of re -entry upon a broken <br />condition subsequent with power to terminate this Agreement; <br />provided, however, that Lessor's right of re -entry shall not be <br />exercised in the event of a broken paragraph 2.04(a) covenant until <br />Lessor shall have given Lessee thirty (30) days prior written <br />notice of breach (which notice shall state the breach with <br />specificity) so as to give the Lessee an opportunity to cure the <br />breach complained of and provide Lessor with adequate assurances <br />that it will not recur, or (z) the right, without termination, to <br />seek injunctive or other equitable relief and, in an appropriate <br />case, damages, or (3) the right to demand strict compliance with <br />-4- <br />r. <br />
