REVISED Abstract &Attachments on 6/26/06 to Correct Event Date ORANGE COUNTY BOARD OF COMMISSIONERS ACTION AGENDA ITEM ABSTRACT Meeting Date: June 27, 2006 Action Agenda Item No. 5-- iJ SUBJECT: Pyrotechnics Permit -Orange Speedway DEPARTMENT: Purchasing & Fire Marshal PUBLIC HEARING: (Y/N) No ATTACHMENT(S): Checklist Permit INFORMATION CONTACT: Pam Jones, 245-2652 Mike Tapp, 968-2050 PURPOSE: To approve a pyrotechnics permit for Orange County Speedway for July 1, 2006 (rain date of July 8, 2006), BACKGROUND: Orange County Speedway has requested that the County Commissioners approve a pyrotechnics permit for the fireworks display which is scheduled for .1tlly 1, 2006 (rain date of July 8, 2006) in conjunction with the regularly scheduled race, GS 14-414 indicates that the Board shall consider a fireworks permit for "any and all kinds of fireworks and explosives, which are used for exhibitions or amusement purposes." GS 14-413 empowers the Commissioners to authorize and issue permits for the use of pyrotechnics in connection with "...shows of all descriptions,..btat only after satisfactory evidence is produced to the effect that said pyrotechnics will be used far the aforementioned purposes and none other." County policy further requires assurance from the sponsoring agency that adequate public safety measures will be exercised; and that the County will be protected as an additional insured on the insurance policy(ies) covering the event. The documents attached indicate satisfactory evidence that these requirements have been met, It should be noted that issuance of the permit is conditioned upon safe burning conditions being present on the day of the fireworks presentation, FINANCIAL IMPACT: There is no financial impact as a result of this action. RECOMMENDATION(S): The Manager recommends that the Board approve a pyrotechnics permit for the Orange County Speedway for July 1, 2006 (July 8, 2006 rain date); and authorize the staff to execute permits as needed.
