Preliminary Plans <br />0 (1) White Oak <br />(9 Lots Chapel Hill Township) <br />Presentation by Eddie Kirk. <br />The property is located on the south side of <br />Davis Road (SR 1129) and the west side of Old <br />Chapel Hill- Hillsborough Road (SR 1009) in Chapel <br />Hill Township. The property is zoned Rural <br />Residential (R -1). The Land Use Element of the <br />Comprehensive Plan designates the area as Rural <br />Residential. <br />There are nine (9) lots proposed out of 28.85 <br />acres. All lots, except lot 4, are proposed to <br />be served by individual wells and septic tanks. <br />Lot 4 does not have a suitable area for a septic <br />tank and has been indicated as being of <br />restricted development potential on the <br />Preliminary Plan. <br />A Class B private road, White Oak Drive, is <br />proposed to serve eight (8) of the nine (9) lots. <br />Lot 9 presently has a mobile home located on it <br />with access off Davis Road. The applicant's <br />private road justification and the Planning <br />Staff's evaluation are attachments to these <br />minutes-on pages <br />The factors used to justify the private road are: <br />1. Larger lots than the minimum required. <br />2. Setbacks significantly greater than required. <br />3. Restrictive Covenants to provide tree <br />protection along property lines and prohibit <br />further subdivision. <br />The Orange County Erosion Control Supervisor has <br />indicated erosion control approval were received <br />previously when the road was constructed for a <br />minor subdivision application. Also, after a <br />site inspection by the Erosion Control Officer, <br />drainage easements are being required on several <br />lots. These easements have been added to the <br />preliminary plan and are included in the <br />Resolution of Approval. <br />The Orange County Engineer has indicated that <br />drainage problems may exist and should be field <br />checked. There was also concern expressed about <br />this road being a possible shortcut. However, <br />with this road being gravel, it should deter this <br />
