Davis <br />Subject: Private Road Justification For White Oak Land Subdivision <br />Gentlemen: <br />A private road is justified in the White Oak subdivision because of the specific <br />nature and location of the subdivision. Specifically: <br />1) The subdivision is designed to preserve the rual character of the area through: <br />a) The subdivision is in a heavy hard- wooded area. <br />W- The restrictions within the covenant does not allow any cutting of trees located <br />on a lot over (6) inches in diami.ter and all redbud, doewood, beech trees of <br />every size shall be retained, unless declarant shall give prior written permission <br />for removal, reason, etc. <br />c) Setback lines are significatlp greater than required. Whereas, the county requires <br />40'. Due to the design of road accomodating the subdivision, lot size, lot depth, <br />the home sites on the lots, setback could vary from 100' to 2001. <br />d) The subdivision connects Davis road on the north and Old Chapel Hill - Hillsborough <br />road on the east. The private road accomodates (4) home sites on Davis mad and <br />(4) home sites near to Old Chapel Hill- Y.illsborough road. <br />e) Since distance is short in the general use of Davis road and O1d'Hillsborough- <br />Chapel Hill road from point of subduvusuon, there's no advantage for the private <br />road to be used by the general public. <br />f) Private entrance identification will be put in place such as small native rock <br />column corners and subdivision name identification design. <br />g) The only open space within the subdivision is the 2000' X 50' (2) acre class (B) <br />road, heavy based and graveled. <br />h) The location of ribad centers through the subdivision, giving good access and view <br />to the woad. <br />i) The location of the road leads to and through the Righest portion of the ladd, <br />keeping it well away from streams to allow sufficient infilLration of storm water <br />run -off prio1: to any run -off reaching streams. <br />J) The type soil is the best in respect to infilteration, having 12" to 15" of top <br />soil and red georgian soil underneath. <br />1 <br />k) Natural wildlife will continue as it is now. The subdivision is surrounded by many - <br />acres of woods and farm land. <br />1) The Orly recreational activities in the area is hiking, fishing near -by local ponds <br />and biking on the main roads. <br />m) The lot consisting of stream, (1) home and farm equipment building, controls a vdde <br />buffer of the stream with only outlet to Davis road, identified on map as lot ff 9• <br />n) The density proposed for this subdivision is verr good, being all wooded, consisting <br />of (7) :* acre and(2) 2* acre lots, allowing much distance between home sites. <br />
