r <br />2 t <br />used to justify the private road are: <br />1. Larger lots than the minimum required. <br />2. Setbacks significantly greater than required. <br />3. Restrictive Covenants to provide tree protection along <br />property lines and prohibit further subdivision. <br />Agency review comments were received as follows: <br />Agency Received <br />Erosion Control 3/20/92 <br />County Engineer 3/25/92 <br />Recreation and Parks 4/15/92 <br />NCDOT 5/11/92 <br />The Orange County Erosion Control Supervisor has indicated <br />erosion control approvals were received previously when <br />the road was constructed for a minor subdivision <br />application. Also, after a site inspection by the Erosion <br />Control Officer, drainage easements are being required on <br />several lots. These easements have been added to the <br />preliminary plan and are included in the Resolution of <br />Approval. <br />The Orange County Engineer has indicated that drainage <br />problems may exist and should be field checked. As <br />indicated above, the Orange County Erosion Control Officer <br />has inspected the site and placed drainage easements on <br />several lots. There was also concern expressed about this <br />road being a possible shortcut. However, with this road <br />being gravel, it should deter this problem. Also, there <br />was a recommendation that the rights -of -way for Davis Road <br />and Old Chapel Hill - Hillsborough Road be dedicated. This <br />requirement has been added on the preliminary plan and in <br />the Resolution of Approval. <br />The Preliminary Plan was reviewed by the Planning Board on <br />May 18, 1992. At that time, the Planning Board <br />recommended approval with a Class B private road based on <br />the findings contained in Section IV- B -3 -d -1 of the <br />Subdivision Regulations and subject to the conditions <br />contained in the Resolution of Approval. <br />RECOMMENDATION: The Administration recommends approval of the Preliminary <br />Plan for White Oak Subdivision with a Class B private road <br />based on the findings contained in Section IV- B -3 -d -1 of <br />the Subdivision Regulations and subject to the conditions <br />contained in the Resolution of Approval. <br />
