representative designated or approved by Landlord to service said heating and air conditioning <br />plant and any additional units. Tenant agrees to provide routine maintenance and repairs to the <br />heating and air conditioning system through its Public Works Department. Costs to Tenant for <br />such shall not exceed $5,000.00 per year. Tenant will provide to Landlord an annual schedule <br />of maintenance. <br />6.3 CONTROLS <br />The heating and air conditioning shall be thermostatically controlled in each leased area; <br />and each tenant shall operate the same in a manner as will comply with governmental <br />regulations. If in the event Landlord shall supply heating and air conditioning, as specified in <br />section 6. 1, then Tenant shall operate the same under the reasonable direction of the Landlord <br />and otherwise so that the temperature within the Demised Premises will be reasonably the same <br />as in other leased areas. <br />ARTICLE VII <br />WASTE, GOVERNMENTAL REGULATIONS <br />7.1 WASTE <br />Tenant shall not commit or suffer to be committed any waste upon the leased premises <br />or any nuisance or other act or thing which may disturb the quiet enjoyment of any other tenant <br />in the building in which the leased premises may be located, or which may disturb the quiet <br />enjoyment of any person within five hundred feet thereof. <br />7.2 GOVERNMENT REGULATIONS <br />Tenant shall, at Tenant's sole cost and expense, comply with all of the requirements of <br />all county, municipal, state, federal and other applicable governmental authorities, now in force, <br />or which may hereafter be in force, pertaining to the said premises, and shall faithfully observe <br />in the use of the premises all municipal and county ordinances and state and federal statutes now <br />in force or which may hereafter be in force. <br />ARTICLE VIII <br />INDEMNIFICATION OF OWNER AND LIABILITY INSURANCE <br />8.1 INDEMNIFICATION <br />Except as to any claim caused by the negligence of Landlord, Tenant shall indemnify <br />Landlord, to the extent permitted by law and to the extent of insurance coverage carried by the <br />• <br />11 <br />
