6 <br />1.3 GENERAL LAYOUT <br />1 0 <br />The Demised Premises are shown and outlined in red on Exhibit A attached hereto and <br />are part of the entire project as described on Exhibit B attached hereto. Said Exhibits set forth <br />a general layout and shall not be deemed to be a warranty or agreement on the part of Landlord <br />that said project will remain exactly as indicated on said diagram. Landlord may increase, <br />reduce, or change the number or location of the walks, building and parking areas as the <br />Landlord shall deem proper, and reserves the right to make alterations or additions to, the <br />building in which the Demised Premises are contained and to add buildings adjoining the same <br />or elsewhere in the project. Use and occupancy by Tenant of the Demised Premises shall <br />include the use in common with others of the common areas and facilities. Nothing herein <br />contained shall be construed as a grant or rental by Landlord to Tenant of the roof and exterior <br />of the building or buildings of which the Demised Premises form a part, or of the walks and <br />other common areas beyond the Demised Premises, or of the land upon which the Demised <br />Premises are located. Landlord shall not relocate Tenant to a different location without Tenant's <br />consent. <br />1.4 CaMMENCEMENT OF TERM <br />The term of this lease, and Tenant's obligation to pay rent, shall commence on the earlier <br />of the following dates provided that Landlord has first notified Tenant that the premises are <br />ready for occupancy: (1) the date on which Tenant shall open the leased premises for business <br />to the public, or (b) July 1, 1991, whichever shall first occur. In the event that the term <br />commences on a day other than the first day of the month, then the term hereunder shall be <br />deemed to commence on the first day of the month next succeeding such date; provided, <br />however, that the Tenant shall pay rent for the fractional month on a per diem basis (calculated <br />on the basis of a thirty day month) until the first day of the month when the term hereunder <br />commences and thereafter the minimum rent shall be paid in equal monthly installments on the <br />first day of each and every month in advance. <br />1.5 LENGTH OF TERM <br />The term of this lease shall be for five (5) years and 0 months following the <br />commencement of the term as provided in the preceding paragraph. Tenant shall have an option <br />to renew this lease for one (1) additional period of five (5) years each under the same terms and <br />conditions thereof, except that the minimum rent during the option period shall be as specified <br />in Section 2.1(a). Option to renew must be exercised by Tenant on or before six (6) months <br />prior to the expiration of the then existing term. <br />1.6 EXCUSE-OF L&N-D-L-ORD'S PERF RMANCE <br />Anything in this agreement to the contrary notwithstanding, providing such cause is not <br />due to the willful act or neglect of the Landlord, the Landlord shall not be deemed in default <br />with respect to the performance of any of the terms, covenants and conditions of this lease if <br />0 <br />
