n <br />The Planning Staff has made positive findings on the <br />application for rezoning to U -1 and NC -2 as required <br />by Article 20 and Article 4 of the Zoning Ordinance. <br />The list of permitted uses in the proposed districts <br />is included in the attachments. The applicant has no <br />plans for developing the property in question. <br />2 <br />RECOMMENDATION: Article 20.3.3 of the Zoning ordinance requires that <br />the Zoning Officer's recommendation be presented to <br />the Planning Board within 30 days of the receipt of an <br />application to amend the Zoning Atlas. The 30 -day <br />period may be extended up to a maximum of 60 days with <br />the written consent of the applicant. The public <br />hearing is the time scheduled for presentation of the <br />Zoning officer's recommendation. <br />Zoning Officer's Recommendation <br />The Zoning Officer has reviewed the application, the <br />site plan and all supporting documentation and has <br />found that the application does comply with the <br />standards set forth in the Zoning Ordinance. Provided <br />the Planning Board and the County Commissioners find <br />in the affirmative, the Zoning Officer recommends <br />approval of the request. <br />No decision is made by either the Planning Board or <br />the County Commissioners at the public hearing. <br />Instead, the Planning Board has 60 days within which <br />to prepare and submit a recommendation to the Board of <br />Commissioners. Failure of the Planning Board to submit <br />a recommendation within the required time shall be <br />considered a favorable recommendation, without <br />conditions. <br />Administration Recommendation <br />The Administration recommends that the application be <br />referred to the Planning Board for a recommendation to <br />be returned to the Board of Commissioners no sooner <br />than August 3, 1992. <br />
