IINTRODUCTION <br />IPage - 1 <br />For a number of years, Orange County has pursued an objective <br />' <br />of helping to fund school capital needs created by growth in the <br />county from financial contributions from the owners of development <br />engendering those capital needs. During the 1987 Session, the <br />General Assembly authorized Orange County to levy impact fees in <br />' <br />its planning jurisdiction for a number of needs, including school <br />capital [See Appendix A for Title VI, Chapter 460, of the 1987 <br />Session Laws]. <br />In 1988 -89, a joint governmental work group investigated the <br />possibilities of levying an impact tax as opposed to a fee. <br />' <br />Subsequently, Orange County proposed legislation in the 1991 <br />Session of the General Assembly seeking the authority to impose an <br />impact tax for school capital needs in the county. Although the <br />legislation was withdrawn due to opposition in the legislature, <br />' <br />Orange County did receive authority to impose impact fees for <br />school capital needs throughout the county, not just within Orange <br />' <br />County's planning jurisdiction [See Appendix B for Chapter 460 of <br />the 1991 Session Laws]. <br />The purpose for this report is to develop a recommended impact <br />' <br />fee structure for financing school capital needs in Orange County. <br />The methodology used to calculate the impact fees is based, in <br />part, on similar techniques used by Anne Arundel County, Maryland <br />and Broward County, Florida, two jurisdictions which have <br />' <br />implemented a system of impact fees for financing school capital <br />needs.
