91 <br />PROPOSED ORDINANCE AMENDMENT <br />ORDINANCE: Subdivision Regulations <br />REFERENCE: Section V -D -6 -b Certificates of Dedication and <br />Maintenance <br />ORIGIN OF AMENDMENT: Staff Planning Board <br />BOCC Public <br />X Other: County Attorney <br />Expected Public Hearing Date: May 26, 1992 <br />Purpose of Amendment: To make a technical correction to the <br />certificate required on a final subdivision plat to be signed by <br />the owner of the property being subdivided. <br />Impacts /Issues: The Certificate of Dedication and Maintenance is a <br />statement required to be placed on the Final Plat and on the <br />Declaration of Development Restrictions and Requirements which is <br />signed by the owner(s) of the property being subdivided. By signing <br />the certificate, the owner certifies that he or she is the owner, <br />that all easements, rights -of -way, and common areas are duly <br />granted for the purposes stated on the plat, and that all <br />improvements /common areas will be maintained until taken over by a <br />public agency or homeowners association, etc. <br />The current language in Section V -D -6 -b of the Subdivision <br />Regulations for the certificate only implies that the person <br />signing is in fact the owner of the property. The proposed <br />amendment will expressly state the certification of ownership. <br />Existing and Proposed Ordinance Text: <br />V- D -6 -b. Certificates of Dedication and Maintenance <br />(1) The following certification shall be printed on the Final <br />Plat and shall be followed by the signature of the <br />owner (s) of the property being subdivided as we;! the <br />acknowledged by a notary public: <br />"The undersigned —hereby certifies that the land <br />shown hereon is owned by the undersigned and is located <br />within the subdivision regulation jurisdiction of Orange <br />County and hereby freely dedicates all rights-of-way, <br />easements, streets, recreation area, open space, common <br />area, utilities and other improvements to public or <br />private common use as noted on this plat, and further <br />assumes full responsibility for the maintenance and <br />
