S4 <br />PROPOSED ORDINANCE AMENDMENT <br />ORDINANCE: Zoning Ordinance <br />REFERENCE: Article 2 - Administration <br />Section 2.2.14.3 - Consideration of Amendments <br />ORIGIN OF AMENDMENT: —X—Staff Planning Board BOCC Citizen <br />STAFF PRIORITY RECOMMENDATION: _$—High Middle Low <br />PUBLIC HEARING DATE: May 26, 1992 <br />PURPOSE OF AMENDMENT: To provide greater flexibility to the Board <br />of Commissioners in conducting public hearings which involve <br />principal amendments to the Comprehensive Plan or portions thereof. <br />IMPACTS /ISSUES: In April of 1988, Article 2, Administration, of the <br />Zoning Ordinance was amended to define the Comprehensive Plan and <br />add procedures for its amendment. Prior to that time, procedures <br />for amending the Land Use Plan (as referred to then) were contained <br />in a policy statement approved by the Planning Board and Board of <br />Commissioners. When the Zoning Ordinance was amended in 1988, the <br />procedures were incorporated into Article 2 with little or no <br />change. <br />Section 2.2.14.3 of Article 2 requires that principal amendments to <br />the Comprehensive Plan only be considered once each year at the <br />quarterly public hearing in February. Since the adoption of the <br />amendment, few applications for principal amendments to the <br />Comprehensive Plan have been processed under the procedures. While <br />applications for principal amendments have generally been held in <br />February, there have been some exceptions. For example, amendments <br />to the Comprehensive Plan involving four township components were <br />considered at a May, 1988 public hearing. More recently, 1992 <br />amendments to the Eno and Chapel Hill township components <br />incorporated the New Hope Open Space Corridor into the <br />Comprehensive Plan. <br />Insofar as other types of amendments are concerned, flexibility is <br />available to the Board of Commissioners in calling special public <br />hearings. While secondary amendments to the Comprehensive Plan, <br />rezoning requests, special use permits, and planned development <br />applications are generally heard at the quarterly public hearings, <br />the language contained in the Zoning Ordinance allows lattitude in <br />setting public hearing dates. <br />Recently, an application was received for the University Station <br />project, a proposed rural village to be located southeast of <br />Hillsborough. The application involves a principal amendment to the <br />Comprehensive Plan, and strict interpretation of Section 2.2.14.3 <br />suggests that the application be considered at the February, 1993 <br />public hearing.
