4 "' <br />NORTH CAROLINA <br />ORANGE COUNTY <br />INTERLOCAL AGR19ZM U <br />THIS INTERLOCAL AGREE made and entered into thisi the <br />day of , 1992, by and between the County Of Oran" -77 <br />North Carol na political subdivision, the Town of Garxxlorcl, a North <br />Carolina municipal corporation, and the Town of Ch�e7l Rill, e <br />North Carolina municipal corporation, pursuant to unapter 1 §0A, <br />Article 20, Part 1, North Carolina General Statutes. <br />WHEREAS, Orange County, the Town of Carrborc and this Town of <br />Chapel Hill own and operate jointly a landfill located in orange <br />County to serve their respective jurisdictions and the fesidento <br />thereof; and, <br />WHEREAS, Orange County, the Town of Carrboro and the Town of <br />Chapel Hill, desire to exercise jointly each agency+''# iedividual <br />authority under N.G. General Statute 40A -11 to enter upon private <br />lands for the purpose of making surveys, borings, emmoLnations and <br />appraisals as may be necessary or expedient toward tte selection <br />and possible acquisition of a site for a future landf III <br />NOW, THEABFCRE, it in hereby agreed by Oraaga Cogntj► and the <br />Town of Chapel Hill and Carrboro as follows: <br />1. The Town of Chapel Hill is hereby authorised sndI iirected <br />to exercise the authority given under G.S. 40A -11 behalf of <br />orange County, and the Towns of Carrboro and Chapel Dill for the <br />purpose of considering possible future sites for a landfill to <br />serve the three respective governmental agencies and their <br />residents. <br />2. All casts associated with the authorised pxe Giae of <br />authority under G.S. 40A -11„ including, but not limited to, Costs <br />of surveys, borings, and examinations, shall be born* by the <br />Present Landfill Fund administered by the Town of Chad Hill. <br />3. This Agreement shall be for the period begiqniqg an the <br />date of execution first above written and extending to June 300 <br />1993. <br />4. This Agreement may be extended or modified by afteeemeat <br />of the parties. <br />
