I4 <br />19 <br />NORTH CAROLINA BEFORE THE BOARD OF <br />ORANGE COUNTY ORANGE COUNTY COMMISSIONERS <br />ORDER CLOSING A PORTION OF ENO MOUNTAIN ROAD <br />(FORMERLY PART OF S.R. 1148) <br />WHEREAS, upon the petition of Tredmont, Inc. and RESCO <br />Products, Inc., which petition is attached hereto as Exhibit A and <br />incorporated herein by reference, the Board of County <br />Commissioners, on March 9, 1992, adopted a resolution declaring <br />its intent to close the portion of Eno Mountain Road (S.R. 1148) <br />identified in blue on the map which is part of Exhibit A <br />(hereinafter "the abandoned road "); and <br />WHEREAS, it appears from the petition that the abandoned road, <br />formerly under the.control and supervision of the North Carolina <br />Department of Transportation, has now been abandoned by the North <br />Carolina Department of Transportation as evidenced by the <br />notification of abandonment which is part of Exhibit A to this <br />resolution; and <br />WHEREAS, as provided by law, the Board of Commissioners of <br />Orange County have conducted a public hearing following notice as <br />required by law, in order to determine that the closing of the <br />abandoned road is not contrary to the public interest and in order <br />to determine that no individual owning property in the vicinity of <br />abandoned the road or in a subdivision in which the abandoned road <br />is located would thereby be deprived of reasonable means of ingress <br />and egress to his or her property; and <br />WHEREAS, the Board finds as a fact from the evidence presented <br />at the public hearing that (1) it is not contrary to the public <br />interest for the abandoned road to be closed, and (2) no individual <br />
