3 <br />5. That the North Carolina Department of Transportation, <br />pursuant to North Carolina General Statutes 5136 -63, has <br />"abandoned" the abandoned road, as evidenced by the notification <br />of abandonment which is part of Exhibit A to this petition. <br />6. That this petition is brought pursuant to N.C. Gen. Stat . <br />5153A -241; that upon information and belief, John Watkins, District <br />Engineer, North Carolina Department of Transportation will be <br />provided with a copy of this petition together with notification <br />of the time and place at which the closing of the abandoned road <br />is to be the subject of a public hearing and action thereafter by <br />the Board of County Commissioners; and that upon information and <br />belief, upon adoption of a resolution by the Board of County <br />Commissioners of its intent to close the abandoned road, the <br />resolution will be published once a week for four (4) weeks prior <br />to the time set for a public hearing on the question of closing the <br />abandoned road. <br />6. That upon information and belief, closing the abandoned <br />road is not contrary to the public interest and no individual <br />owning property in the vicinity of the abandoned road will be <br />deprived of reasonable means of ingress and egress to his or her <br />property. <br />7. That the abandoned road should be closed and the title <br />thereto vested in the petitioners and other property owners whose <br />property abuts the abandoned road as provided by N.C. Gen. Stat. <br />§153A -241. <br />F <br />
