(919) 929 -6069 <br />APPLICATION FOR CHANGE IN ZONING <br />P & S SPORTING GOODS, INC. <br />ORANGE COUNTY - BINGHAM TOWNSHIP <br />TAX REFERENCE 6.26..28 <br />Prepared: March 27, 1992 <br />STATEMENT OF JUSTIFICATION <br />1.0 GENERAL INFORMATION <br />The orange County Land Use Plan indicates that commercial <br />activities are appropriate within certain identified activity <br />nodes and generally inappropriate outside these nodes. The <br />subject property is located within an activity node <br />identified as the BH -1 Rural Neighborhood Activity Node. <br />This node is centered at the intersection of NC Highway 54 <br />and SR 1958 (Morrow Mill Road) and it's quarter -mile radius <br />extends beyond the subject property, thereby encompassing it <br />within the node. <br />P & S Sporting Goods, Inc., is the owner of two (2) lots <br />identified as 6.26..28 and 28A. Lot 28A is currently zoned <br />General Commercial -4 (GC -4). Lot 28 is currently zoned a <br />combination of General Commercial -4 (GC -4) and Agricultural <br />Residential (AR). The AR portion of the lot comprises 5.14 <br />acres. The zoning of this 5.14 acres is proposed to be <br />changed as follows: <br />1.92 Acres Neighborhood Commercial -2 (NC -2) <br />2.06 Acres Local Commercial -1 (LC -1) <br />1.16 Acres Agricultural. Residential (AR) <br />5.14 Acres <br />2.0 CHANGED OR CHANGING CONDITIONS <br />When the first commercial zoning was applied to the subject <br />property, the existing subsurface sewage disposal systems <br />were in the residentially zoned portion of the property, <br />which was consistant with the interpretation of the Orange <br />County Zoning Ordinance at that time. Current policy and <br />interpretation will allow sewage disposal systems only in the <br />commercially zoned portions of property which are commercial <br />developments. This change in policy and interpretation has <br />made the existing systems non - conforming with regard to this <br />land planners . landscape designers . local government planners <br />
