_i <br />-'4- <br />i►� <br />r <br />Zoning Atlas amendments will require notification <br />of individual property owners. The notice must be <br />mailed on or before May 8, 1992. <br />A public hearing on a proposed system of school <br />impact fees is required, because Orange County's <br />enabling legislation was incorporated into the N.C. <br />General Statutes as part of Article 18 of Chapter <br />153A. An ordinance establishing such impact fees <br />must be adopted, and the ordinance must be <br />advertised for public hearing in the same manner as <br />the other planning items. <br />The Planning Board considered the proposed <br />ordinance text amendments at its April 20, 1992 <br />meeting and recommended that they be presented at <br />the May 26, 1992 public hearing for citizen <br />comment. <br />The proposed Comprehensive Plan amendment does not <br />comply with the provisions of Article 2.2.14 of the <br />Zoning Ordinance. The proposal is considered a <br />principal amendment, since it involves an addition <br />to an existing Plan area of more than 100 acres. <br />Principal amendments are to be considered once a <br />year at the quarterly public hearing-in February. <br />Because of time constraints associated with <br />assembling multiple properties to form a unified <br />project, the applicant is requesting that a special <br />public hearing be set in conjunction with the May <br />26, 1992 meeting. While such requests are not <br />common, they are not without precedent. Similar <br />provisions exist for Zoning Ordinance text and <br />Atlas amendments, including planned development <br />applications and Special Use Permits. In 1990 and <br />1991, special rezoning hearings were conducted <br />citizen's request. In 1989, a Special Use Permit <br />application and Zoning ordinance text amendment <br />were considered at special hearings. <br />RECOMMENDATION: The Administration recommends approval of the <br />Notice of Public Hearing for May 26, 1992. The <br />Administration also recommends that application <br />CP -1 -92 be included for consideration on the May <br />26, 1992 public hearing agenda. <br />
