Article 12 continued from Page No. 10 <br />12.5 Reference subparagraph 2.4.5 - The Architect shall include in the bidding <br />information, plans or specifications, a requirement that Prime Contractors provide <br />operation manuals and adequate training for the experienced staff of the Owner <br />in the operation of mechanical,, electrical, heating and air- conditioning systems <br />installed by the Prime Contractors. <br />12.6 Reference subparagraph 2.6.3 - Construction Phase duties, responsibility and <br />limitation of authority of the Architect shall not be restricted, modified or <br />extended without written agreement of the Owner and Architect and notice to <br />Prime Contractors. <br />12.7 Reference subparagraph 2.6.4 - The Architect shall be the representative of the <br />Owner during the construction phase of the contract period, and shall advise and <br />consult with the Owner. Instructions to the Prime Contractors shall be forwarded <br />through the Architect. The Architect shall have authority to act on behalf of the <br />Owner only to the extend provided in this Agreement, unless otherwise modified <br />by written agreement. <br />12.5 Reference paragraph 2.6.5 - The Architect shall visit the site periodically at <br />intervals appropriate to the stage of construction, and shall review the work in <br />progress during these on -site visits to endeavor to determine for the Owner's <br />benefit and protection if the work is proceeding in accordance with the intent of <br />the Contract Documents and the construction schedule. The Architect shall be <br />held to the standard of care (with regard to review by on -site visits) which is <br />generally accepted in the industry among architects of similar skill and standing <br />in the community. <br />The Architect shall not be responsible for construction means, methods, <br />techniques, sequence or procedures or for safety precautions and related programs <br />in connection with the work; and he shall not be responsible for the Prime <br />Contractors' schedules or failure to carry out the work in accordance with the <br />Contract Documents. <br />Basic Services include not more than thirty -six (36) site visits during the <br />construction phase. (A site visit is one visit by one person for not more than one <br />day.) If more site visits are required such visits shall be Additional Services and <br />shall be paid for in accordance with Paragraph 11.3. <br />Article 12 continued on Page No. 12 <br />11 <br />
