14 , <br />agricultural district within which the proposed action is <br />to take place. <br />3. The Board will consult with the Orange County Cooperative <br />Extension Service, the local U.S.D.A. Soil Conservation <br />service office, and the Orange County Planning Department, and <br />may consult with any other individuals, agencies or <br />organizations, public or private, necessary to the Board's <br />review of the proposed action. <br />4. Within 30 days after the request for public hearing, the Board <br />will make a report to the decision - making body of the proposed <br />condemnor, which report shall contain the Board's findings and <br />recommendations regarding the proposed action. <br />5. Pursuant to N.C. Gen. Stat. Section 106 -740, the proposed <br />condemnor shall not formally initiate a condemnation action <br />while the proposed condemnation is properly before the <br />advisory board within these time limitations. <br />Section VIII - RECORD NOTICE OF PROXIMITY TO FARMLANDS <br />A. PURPOSE <br />The purpose of this section is to help prevent potential conflicts <br />from occurring between qualifying farms and non -farm landowners <br />regarding acceptable and responsible farming operations and <br />practices, and to minimize the incidence of nuisance suits against <br />owners of qualifying farmland. <br />B. PROCEDURE <br />Upon certification of qualifying farmland and designation of real <br />property as a voluntary agricultural district, the orange County <br />Land Records System shall be changed to include a notice reasonably <br />calculated to alert a person researching the title of a particular <br />tract that such tract is located within one -half mile of a <br />voluntary agricultural district. <br />(G.S. 106 -741 (a) states that the computerized land records system <br />of a county may be set up to include a notice to alert persons <br />conducting title research that a particular tract is located <br />within: <br />1. One -half mile of a poultry, swine or dairy qualifying farm; <br />2. 600.feet of any other qualifying farm; or <br />3. One -half mile of a voluntary agricultural district. <br />While the above uses may seem different, the key term is <br />qualifying farm. A qualifying farm is one which meets the criteria <br />set forth in Section V.D. Since a farm must meet the criteria in <br />order to qualify for inclusion in an agricultural district, and a <br />farm must be in a voluntary agricultural district to benefit from <br />
