Box 8181 <br />Hillsborough, NC 27278 <br />Dear Commissioner Carey: <br />February 12, 1992 <br />This letter is to follow -up on our discussion of property tax <br />exemption for Culbreth Park Community Development <br />Corporation for 1991. <br />Culbreth Park appeals to the County Commissioners for a <br />refund of $9,639.94 for taxes and interest paid on 24 lots <br />for 1991 as detailed in the attachment. <br />After lengthy discussions with Kermit Lloyd, John Horner and <br />Rob Visser, the status of our September 23, 1991 application <br />is that the county staff agrees certain lots qualify for the <br />exemption. However, since our application was late (deadline <br />was January 31, 1991), the staff says Culbreth must appeal to <br />the Board of Commissioners for approval as outlined-in <br />statute 105- 282.1(a)(5): <br />Upon a showing of good cause by the applicant for <br />failure to make a timely application, an application for <br />exemption. or exclusion filed after the close of the <br />listing period may be approved by the...board of county <br />commissioners ... as appropriate. An untimely application <br />for exemption or exclusion approved under this <br />subdivision applies only to property taxes levied by the <br />county or municipality in the calendar year in which the <br />untimely application is filed. <br />Our reason for good cause is simple. The individual who <br />designed, developed, and managed Culbreth Park became gravely <br />ill in the Fall of 190. During that time no one was able to <br />devote the necessary management time to control a $5 million <br />project. Since Culbreth had endeavored to keep management <br />costs low, there was no management back -up to fill in.
