RTiQENT T `COUNTY _ATTOR]9Z1 _ _ _ _ <br />A: =AC MENT(S) <br />Petition <br />11/1/87 and 11/15/87 Resolutions <br />Resolution <br />N.C.G.S. §153A -241 <br />P:'BLIC�HEARING YES : N0: X <br />INFORMATION CONTACT: Geoffrey Gledhill, <br />County Attorney, <br />TELEPHONE NUMBER- 732 -2196 <br />.Hillsborough - 732 -8181 <br />Chapel Hill -,968 -4501 <br />Mebane - 2.27 -2031. <br />Durham - 688 -7331 <br />PURPOSE: To consider a resolution declaring the intent of the Board of <br />Commissioners to close a portion.of Eno Mountain Road. <br />BACKGROUND: In November 1987 the Board of Commissioners adopted two <br />resolutions (the first on November 1, 1987; the second on.November 15, 1987) <br />expressing its support of the straightening and paving of Eno Mountain Road, <br />generally from the Eno River south to its intersection with Orange Grove <br />Road. Those resolutions requested- the North. Carolina Department of <br />Transportation to abandon the Eno -. Mountain .Road right of 'way that existed <br />then and that would no longer be -used after the road straightening and paving <br />project was complete. Finally, the.Board resolved that it would do its part <br />in the process of abandoning Eno Mountain Road by declaring -its intent to <br />close the abandoned portion of the,road -and to hold a public hearing on the. <br />closing. This latter step ,was .an important feature in the agreement to <br />straighten and improve Eno Mountain-.,Road because the owners of the property <br />abutting the,new road gave the Department of Transportation the right of way <br />for the road improvements with the expectation that the.right of -way for the <br />abandoned portion of, the road would revert to them as provided by law in the <br />case of a closed public road. <br />The road project is now complete and -the' North Carolina- Department of <br />Transportation has abandoned, for maintenance purposes, the old road. With <br />a letter dated February 24, 1992, the County Attorney received a petition <br />from 'Tredmont, Inc. and Resco Products, Inc., owners of a substantial <br />portion of the abandoned segment of Eno fountain Road, formally requesting <br />that the abandoned section of the - road. be closed., . -The next step in this <br />process is for the Board of Commissioners to adopt the - attached resolution <br />declaring its intent to close the public road and to set the public hearing <br />for the road closing. At the conclusion , of -the public hearing the Board can <br />formally close the road provided it -can make the findings of fact which are <br />required by the statute authorizing road closings which statute is. also <br />attached to this agenda abstract.. <br />RECOMMENDATION: The Manager and the County Attorney I recommend the <br />adoption of the resolution declaring the Board's intent to.c.lose designated <br />portions of Eno Mountain Road. <br />
