Information is also provided regarding <br />Procedures for the disposition of any county government -owned property. <br />BACKGROUND: <br />The Commissioners have expressed interest in selling the property it <br />purchased for the Solid Waste Collection Site on Frazier Road (Cheeks <br />Township.) The Recreation and Parks Advisory Council has requested that <br />the county offer the use of the property for recreation purposes to the <br />residents of the Perry Hills Subdivision while the sale of the property is <br />pending. <br />Options available to the County to allow this use are (a) sell the <br />property to the Perry Hills residents, or (b) lease the property to a <br />Homeowners Association. <br />SALE OPTION: County Governments are directed by G.S. 153A -176 to dispose <br />of property in the same manner as city governments and in accordance with <br />the procedures set forth in G.S. Chapter 160A, Article 12 (G.S. 160A -265 <br />through 277). Under the North Carolina Constitution, it is generally <br />unconstitutional for a local government to dispose of property for less <br />than its fair market value. Most of the procedures by which a <br />county is permitted to sell or otherwise dispose of property are <br />competitive. <br />
