ordinance have been expanded to include all dwellings within the County, <br />not just rental units. Provisions in Article XVIII allow for the <br />continued use of a dwelling existing on the date of ordinance adoption <br />provided that it does not represent a threat to the general safety and <br />welfare of the occupant or public. <br />COMMENTS /QUESTIONS FROM THE BOARD OF COMMISSIONERS OR PLANNING BOARD <br />In response to a question from Bill Waddell, Mr. Collins <br />indicated that there is no official estimate of potential cost to the <br />property owner. All enforcement has been the direct result of citizen <br />complaints and that will continue in the future. Each investigation <br />will be the result of a written petition. The Planning Department does <br />not have sufficient staff to operate a systematic enforcement program. <br />He stated that this code attempts to maintain the value of existing <br />homes rather than letting them depreciate. <br />A motion was made by Commissioner Halkiotis, seconded by Chairman <br />Carey, to refer this item to the County Manager for a recommendation to <br />be returned to the Board of Commissioners no sooner than March 24, 1992. <br />VOTE: UNANIMOUS <br />3. ZONING ORDINANCE ATLAS AMENDMENTS <br />a. Z -1 -92 Lawton Cabinet Shop <br />This item was presented by Planner Emily Cameron to <br />receive citizen comment on a proposed Zoning Atlas amendment in Bingham <br />Township. An error has been discovered in the Zoning Atlas as it <br />applies to Bingham Township. An Existing Commercial (EC -5) designation <br />was approved for an existing cabinet shop on the south side of Old <br />Greensboro Road (SR 1005) between Ferguson Road (SR 1948) and Ivey Road <br />(SR 1947). The EC -5 lot is part of lot 23 on tax map 37 of Bingham <br />Township which is currently zoned Rural Buffer, Protected Watershed II, <br />and ULW. Surrounding land uses are agricultural and residential. <br />Adjacent zoning is Rural Buffer, PWII, and University Lake Watershed. <br />In 1981 the EC -5 lot was drawn incorrectly on the Zoning Atlas. <br />The cabinet shop is located on the central and eastern portions of a 4- <br />acre tract. The zoning lot was shown adjacent to the western boundary <br />on an undeveloped portion of the tract. The EC -5 zoning lot approved in <br />1981 was 66,000 square feet (1.52 acres) in size. The proposed <br />relocated zoning lot is the same. <br />The planning staff proposes to correct the Zoning Atlas by <br />shifting the EC -5 lot approximately 245 feet to the east to include the <br />existing cabinet shop, office, driveway, and parking. The PWII and ULW <br />overlay zoning districts will remain in place. <br />A motion was made by Commissioner Gordon, seconded by <br />Commissioner Willhoit to refer this item to the Planning Board for a <br />recommendation to be returned to the County Commissioners no sooner than <br />April 6, 1992. <br />VOTE: UNANIMOUS <br />
