Developer James L Anthony, Jr_ TOWN OF HILLSBOROUGH
Project Corne SEWER EXTENSION CONTRACT
APPENDIX A
Developer, the Town and County agree to satisfy the following
conditions in addition to those set forth in the SEWER EXTENSION
CONTRACT before the Town will permit the connection of improvements
constructed for the above - referenced project to the Town sewer
system:
1. Developer shall construct and install or cause to have
constructed and installed at Developer's sole expense the
referenced sewer extension project.
2. The County agrees to pay to the Developer the amount of
$78,000 toward the cost of that segment of the 18" gravity sewer
line to be constructed by Developer pursuant to this contract which
extends from the Elizabeth Brady pump station under and to the
South side of US Highway 70A. This segment of the extension will
benefit a proposed industrial development in the County.
3. The Town agrees to pay to the Developer the amount of
$75,000 toward the cost of constructing that segment of the 18"
sewer line to be constructed by the Developer pursuant to this
contract which extends from the Elizabeth Brady pump station under
and to the South side of US Highway 70A. The Town's contribution
represents approximately the difference between the cost of the 16"
line that the Town requires to serve properties other than the
project property and the cost of an 8" line that would be the
minimum size required by the Town to serve the project property
only.
4. The Town agrees to pay the Developer the amount of
$20,000 toward the cost of constructing that segment of the 18"
sewer line to be constructed by the Developer pursuant to this
contract which extends from the south side of US Highway 70A to the
project property. The Town's contribution represents approximately
the difference between the cost of the 18" line that the Town
requires to serve properties other than the project property and
the cost of an 8" line that would be the minimum size required by
the Town to serve the project property only.
5. By means of a separate agreement between DCA General and
Meadowlands Associates, Meadowlands Associates or its successors
or assigns agrees to pay to Developer the amount of $30,000 toward
the cost of the Project, representing the approximate savings
realized by not having to construct a redundant and unnecessary
sewer line. As a matter of public record only, Meadowlands has
further agreed not to make connection to the line until such
payment is made with interest. Notwithstanding the foregoing, the
Town will allow Meadowlands to connect to its system upon the
payment of fees in accordance with the. Town's ordinances and
