D. Post - Construction Conditions: <br />Before the Town will permit use of the Town sewer system to <br />serve the Project, Developer shall: <br />1. Furnish the Town two copies of the record drawings, <br />together with <br />a) the contractor's affidavit that the drawings accurately <br />represent the as -built improvements, and <br />b) a certificate of compliance executed by the engineer of <br />record indicating that work has been performed in <br />substantial compliance with the approved plans and <br />specifications. <br />2. Convey to the Town and record or cause to have recorded <br />in the Orange County Registry all deeds of easements and plats <br />showing all water and /or sewer required to serve the Project. The <br />Town acknowledges that as of the date of this contract this <br />condition has been satisfied. <br />3. Formally dedicate to the Town all physical improvements <br />constructed to serve the project that is the subject of this <br />contract, which improvements shall become part of the Town sewer <br />system and will thereafter be owned and maintained by the Town. <br />Acceptance by the Town of the offer of _ dedication shall be by <br />resolution of the Board of Commissioners, which resolution shall <br />constitute a certification by the Town that the Developer has <br />complied with all of the terms and conditions of this agreement <br />(hereinafter referred to as "Acceptance "). Acceptance will occur <br />at the first Town Board meeting following the date of execution of <br />the Certificate of Compliance from the Engineer of Record. Time <br />is of the essence and the Town may not unreasonably delay <br />Acceptance. <br />E. Payment of Capital Facilities Fees For Non - Residential <br />Projects <br />All water and sewer capital facilities fees must be paid no <br />later than the time when connection is made between the lines <br />constructed to serve each water customer ( water meter) and the main <br />lines or lateral lines constituting the extension of the town's <br />system. The amounts of the fees for non - residential projects are <br />based on the number and size of water meters to be served and the <br />total acreage to be served as set forth in Chapter 14, Appendix A <br />of the Hillsborough Town Code and the Town's Sdhedule of Water and <br />Sewer Fees Charges. Non - residential capital facilities fees shall <br />be paid by the individual or entity requesting service, whether the <br />Developer or his successor in interest. <br />�I <br />
