B. Pre - Construction Conditions Which have been Satisfied_as of <br />Date of Execution: <br />1. The Developer has engaged a registered professional <br />engineer to prepare plans and specifications for the construction <br />of sanitary sewer improvements to serve the Project. <br />2. The <br />plans by the <br />applicable: <br />the Town <br />the North <br />the North <br />Natural <br />the North <br />Developer has secured approval of the construction <br />following agencies or authorities, to the extent <br />Carolina Department <br />Carolina Department <br />Resources <br />Carolina Department <br />of Human Resources <br />of Environment, Health and <br />of Transportation <br />3. The Developer has obtained at its expense any necessary <br />encroachment agreements or easements for use of property not owned <br />by the undersigned developer or project owner. <br />C. Construction Conditions: <br />1. Unless otherwise provided in this contract, all <br />construction shall be in accordance with Town policy, standards and <br />specifications. <br />a) The Town has approved the size and type of material for <br />all sewer lines as provided in the plans and <br />specifications furnished by Rice and Associates. <br />b) All work shall be subject to inspection by the Town. No <br />line may be covered up until such inspection has taken <br />place and if any line or facility is covered up prior to <br />inspection, the Town may require such line or facility <br />to be uncovered or exposed to view at the Developer's <br />expense to facilitate such inspection. <br />C) The Town may require any testing it deems appropriate to <br />determine that the work complies with Town standards and <br />specifications. All such testing shall be at the <br />Developer's expense. <br />d) The Developer's engineer or surveyor shall provide <br />construction stake out and supervision. <br />e) All construction shall be performed by a contractor <br />licensed to perform this type of work in North Carolina. <br />2. Subject to the provisions of Appendix A to this contract, <br />the Developer shall bear the total cost of all water and /or sewer <br />construction within the Project and the total cost of all water <br />and /or sewer construction required to extend service to the <br />Project. <br />4 <br />
