29 <br />off duty, tend to be less productive, less reliable, <br />and prone to greater absenteeism resulting in the <br />potential for increased cost, delay and risk in <br />providing services. Ultimately, they threaten the <br />county's ability to serve the public. <br />Furthermore, employees have the right to work in a <br />drug and alcohol free environment and to work with <br />persons free from the effects of drug or alcohol <br />abuse. Employees who abuse drugs or alcohol are a <br />danger to themselves, other employees and the <br />public. In addition, substance abuse inflicts a <br />terrible toll on the county's productive resources <br />and the health and well -being of Orange County <br />workers and their families. <br />Orange County is therefore committed to maintaining <br />a safe and healthy workforce free from the influence <br />of substance abuse. In addition, Orange County will <br />vigorously comply with the requirements of the <br />Federal Drug -Free Workplace Act of 1988 and <br />implement rules promulgated by the United States <br />Office of Management and Budget that will affect all <br />employees in general and federal grant funds <br />administrative employees, in specific. <br />10.2 Polite - It shall be the policy of the Orange County <br />to maintain a workforce free of substance abuse. <br />10.3 Reporting to work or performing work for the county <br />while impaired by or under the influence of any <br />intoxicant, drug or chemical which interferes with <br />the employee's work performance or which might <br />adversely affect safety. <br />10.4 The illegal use, possession, dispensation, <br />distribution, manufacture or sale of controlled <br />substances by employees at the worksite, during work <br />hours, or while the employee is on duty, official <br />county business, or stand -by duty is prohibited. <br />10.5 Violation of such prohibitions by county employees <br />is considered conduct detrimental to county service <br />and will result in disciplinary action in accordance <br />with Article IX, Section 4.6 of this Ordinance. <br />10.6 Employees are required to notify the employing <br />department head or designee within five (5) days of <br />any criminal drug statute conviction where such <br />conviction was due to an occurrence at the worksite, <br />during work hours, or while on duty, official <br />business, or stand -by duty. <br />10.7 An employee who is convicted of violating any <br />
