In accordance with Office of Management and Budget (CHB) Circular A -128, "Audits of State and Local Goverment ", dated April 2, 1985, and the Single Audit Act of 1984, the Contractor shall arrange for an independent financial and compliance audits of its fiscal operations. The Contractor shall furnish the Department with a copy of the independent audit report within thirty (30) days of completion of the report, but no later than one (1) year after the end of the audit period. Section 7. Contracts Under This Agreement. Unless otherwise authorized in writing by the Department, the Contractor shall not assign any portion of the work to be performed under this Agreement, or execute any contract, amendment, or change order thereto, or obligate itself in any manner with any third party with respect to its rights and responsibilities under this Agreement without the prior written concurrence of the Department. Further, the Contractor shall incorporate the provisions of this Agreement into any vehicle lease arrangement and shall not enter into any vehicle lease arrangement without the prior concurrence of the Department. Any lease approved by the Department shall be subject to the conditions or limitations governing the lease of Project equipment as set forth by FTA and the Department. Section 8. Purchase of Project Equipment. The purchase of project equipment pursuant to this Agreement shall be undertaken in accordance with either of the options in this Section: (a) Purchase b X the Department. The Department may act as the procurement agency on behalf of the Project, purchasing equipment through the North Carolina Department of Administration, Purchase and Contract Division.
