of a physical or mental impairment. Action may be <br />initiated by the employee or the County, but in all <br />cases it must be supported by medical evidence as. <br />certified by a competent physician. The County may <br />require an examination at its expense and performed by <br />a physician of its choice. Before an employee is <br />separated for disability, a reasonable effort shall <br />be made to locate alternative positions within <br />County service for which the employee may be suited. <br />3.4 Retirement <br />Whenever an employee meets the conditions set forth <br />under the provisions of any retirement plans <br />adopted by the Commissioners for County employees, <br />the employee may elect to retire and receive all <br />benefits earned under the retirement plan. <br />3.5 Death <br />All compensation due in accordance with this Ordinance <br />will be paid to the estate of a deceased employee. <br />The date of death shall be recorded as the separation <br />date for computing compensation due. <br />3.6 Suspension and Dismissal <br />As discussed in the following section. <br />4.0 DISCIPLINARY ACTION, SUSPENSION AND DISMISSAL <br />It is the intent of Orange County Government in <br />establishing this policy to provide County employees a fair, <br />clear and useful tool for correcting and improving <br />performance problems, as well as to provide a process to <br />assist management in handling instances of unacceptable <br />personal conduct. <br />Orange County recognizes that, consistent with sound <br />employee relations practices, it is most important that <br />disciplinary action, suspension and dismissal be <br />administered in as near a uniform manner as possible. To <br />assist all levels of- supervision.in promoting efficiency and <br />equitable treatment for all employees the following is <br />established: <br />4.1 Policy <br />Any employee, regardless cf occupation, position or <br />profession may be warned, demoted, suspended or <br />dismissed for just cause. The degree and type of <br />action taken shall be based upon the sound and <br />considered judgment of the appropriate authority in <br />accordance with the provisions of this policy. <br />4.2 Procedure <br />
