Dedication of recreation /open space. <br />Access to lots 1 and 6 will be restricted to the <br />private road. <br />Agency review comments were received as follows: <br />Agency Received <br />Town of Carrboro 11/15/91 <br />Town of Chapel Hill 11/11/91 <br />Erosion Control 11/7/91 <br />Triangle Land Conservancy 12/2/91 <br />Recreation and Parks 12/5/91 <br />Courtesy review comments from the Town of Carrboro <br />Planning Staff included impervious surface calcula- <br />tions, protection for the stream buffer and flood - <br />plain, and driveway locations. <br />Dedication of public recreation /open space is <br />required since both Phil's Creek and its tributary on <br />the eastern boundary of the subdivision are designated <br />as greenways in the Joint Planning Area Land Use Plan. <br />Such a dedication was included as a condition of <br />approval on the Concept Plan. <br />On the Preliminary Plat, the applicant has shown a 20- <br />foot "Private Recreation and Creek Access Easement" in <br />addition to a perpetual conservation easement over the <br />entire 100 -year floodplain dedicated to Triangle Land <br />Conservancy. Neither of these indications can <br />substitute for the required dedication of public <br />recreation /open space. <br />The Director of Recreation and Parks met with the <br />applicant last May to discuss the recreation <br />dedication. She recommended that a 10 -foot strip be <br />dedicated for public access located entirely within <br />the conservation easement along Phil's Creek, but not <br />along the tributary on the eastern boundary. Changes <br />to the language of the draft conservation easement <br />agreement would be necessary to allow public access, <br />improvements, and recreation activities within the 10- <br />foot greenway. <br />The dedicated area should be located within 30 feet of <br />the centerline of Phil's Creek. This distance from the <br />creek is necessary to insure that usable land will be <br />dedicated. The 20 -foot wide strip shown as private on <br />the Preliminary Plan is not adequate, since some, if <br />not all, of that width would be in the water in many <br />
