fl <br />APPLICATION FOR MODIFICATION OF SPECIAL <br />USE PERMIT FOR STONEGATE MOBILE HOME PARK <br />In response to a letter from the Planning Department dated August <br />26, 1991 and pursuant to Section 8.7.3 of the Orange County Zoning <br />Ordinance, Dorothy C. Bane seeks a modification of her Special Use <br />Permit (Permit, herein) for the development of Stonegate Mobile Home <br />Park (Park, herein). This modification is necessitated by a change in <br />the wastewater disposal system for the Park. <br />The original Permit was issued in October of 1982 and called for <br />wastewater to be disposed of via a private wastewater treatment plant <br />(plant, herein) into Rhodes Creek (Creek, herein). At that time Mrs. <br />Bane held NPDES Permit No. NCO049808, Stonegate Mobile Home Park, <br />Orange County which had been granted by the State of North Carolina, <br />Department of Environmental Management (DEM, herein) effective March <br />1, 1980 (NPDES permit, herein). The NPDES permit was subject to <br />renewal each five years upon application six months in advance of its <br />February 28th expiration date. It had been timely renewed effective <br />March 1, 1985. The application for renewal to be effective March 1, <br />1990 was timely filed with and received by DEM on August 30, 1989. On <br />December 15, 1989 Mrs. Bane was informed by DEM that Rhodes Creek had <br />been reclassified and DEM gave notice of intention to deny the <br />application for renewal of the NPDES permit. DEM suggested several <br />alternatives to wastewater disposal into the creek, including spray <br />irrigation and low pressure injection. <br />After investigating several options, Mrs. Bane decided, upon the <br />advice of S. v. Credle, Professional Engineer, Credle Engineering <br />Company, Inc., Durham, North Carolina (Credle, herein), to install a <br />
