Second, opposition to the proposed <br />requirement that the surveyor certify that the plat <br />creates a subdivision in orange County's planning <br />jurisdiction was expressed. It was suggested that the <br />requirements of the legislation could be met by the <br />certifying only that the property was located in "an area <br />subject to zoning regulations ". <br />The concerns expressed by the Society of Surveyors were <br />reviewed by the Planning Staff and the County Attorney. <br />The language recommended by the Society of Surveyors was <br />found to be consistent with the General Statutes. The <br />proposed amendment has been revised to make reference to <br />the General Statutes, without duplicating the specific <br />provisions. This approach should satisfy all concerns <br />expressed by the Society of Surveyors, while maintaining <br />consistency with the Statutes. <br />However, there is some concern with the wisdom of G.S. 47-- <br />30 due to potential for abuse. It would be possible for a <br />surveyor to consistently certify that he /she is unable to <br />make a determination as to whether or not the survey is in <br />an area governed by subdivision regulations, whether it is <br />a survey or an existing parcel, or whether it falls under <br />one of the exceptions-to the definition of subdivision. <br />Over- reliance on the "I know nothing" surveyor certificate <br />would be counter to the desired effect of the legislation. <br />If use of this certificate occurs unnecessarily, then <br />Planning Staff may bring the abuse to the attention of the <br />Board of Commissioners, and recommend that the County <br />require more stringent certification, or request that the <br />Society of Surveyors take a formal position that G.S. 47- <br />30 as amended is flawed, and should be revised. If all <br />surveyors apply the provision of G.S. 47 -30 in good faith, <br />then there should be no problem. <br />The Planning Board considered the proposed amendment, as <br />revised to address concerns of the Society of Surveyors, <br />on December 16, 1991 and recommended approval. <br />RECOMMENDATION: The Administration recommends approval of the proposed <br />amendment as revised as follows to incorporate comments of <br />the Society of Surveyors, per the Planning Board <br />recommendation. <br />Definitions:- Subdivision <br />V -D -6 - Certificates and Endorsements to appear on Final <br />Plats <br />
