M 01� ®rA U � U 34 <br />Access to lots 1 and 6 will be restricted to the <br />private road. <br />Courtesy review comments from the Town of <br />Carrboro Planning Staff included impervious <br />surface calculations, protection for the stream <br />buffer and floodplain, and driveway locations. <br />Dedication of public recreation /open space is <br />required since both Phil's Creek and its <br />tributary on the eastern boundary of the <br />subdivision are designated as greenways in the <br />Joint Planning Area Land Use Plan. Such a <br />dedication was included as a condition of <br />approval on the Concept Plan. <br />On the Preliminary Plat, the applicant has shown <br />a 20 -foot "Private Recreation and Creek Access <br />Easement" in addition to a perpetual conservation <br />easement over the entire 100 -year floodplain <br />dedicated to Triangle Land Conservancy. Neither <br />of these indications can substitute for the <br />required dedication of public recreation /open <br />space. <br />The Director of Recreation and Parks met with the <br />applicant last May to discuss the recreation_ <br />dedication. She recommended that a 10 -foot strip <br />be dedicated for public access located entirely <br />within the conservation easement along Phil's <br />Creek, but not along the tributary on the eastern <br />boundary. Changes to the language of the draft <br />conservation easement agreement would be <br />necessary to allow public access, improvements, <br />and recreation activities within the 10 -foot wide <br />strip. <br />where possible, the dedicated area should be <br />located within 30 feet of the centerline of <br />Phil's Creek. This distance from the creek is <br />necessary to insure that,.usable land will be <br />dedicated. The 20 -foot wide strip shown as <br />Private on the Preliminatyllan is not adequate, <br />since some, if not all, of that width would be in <br />the water in many places along the creek. <br />The applicant has negotiated a perpetual <br />conservation easement with Triangle Land <br />Conservancy which includes the entire 100 -vear <br />floodplain. A draft of the easement agreement <br />was submitted with the Preliminary Plan. <br />The Concept Plan was reviewed by the Planning <br />Board on January 28, 1991. At that time, the <br />
