SAWYER <br />(1902-1972) Hillsborou g h, North Carolina 27278 <br />RE: Featherwood, Phase I <br />Dear Jane: <br />The enclosed copy of the road maintenance <br />agreement for Featherwood Court, the private road <br />located in Phase I of Featherwood, satisfies the Orange <br />County Subdivision Regulations. <br />With a copy of this letter to Marvin Collins, I am <br />confirming our conversation on July 18, 1991 regarding <br />his July 15, 1991 memorandum to me. The concern <br />expressed in my July 3, 1991 letter about the so- called <br />"residual" parcel being excluded from consideration as <br />part of this subdivision was not a private road <br />concern. Rather, it was that the division of the 15+ <br />acre parcel is just that. Five lots are being created, <br />one of which is greater than ten acres. Since the <br />subdivision was approved wit a priyate road, the <br />prohibition against further subdivision contained n <br />Section IV- B -3 -d -1 (the next to last paragraph which <br />reads: "Restrictive covenants which prevent further <br />subdivision of the property shall be made a condition <br />of approval of a private road. ") e� rtain. And, as <br />indicated in my July 3, 1991 letter, other lot <br />standards also pertain to the so- called residua <br />arcel. <br />I recognize that this minor subdivision has been <br />approved in the form presented to me with Jane <br />Garrett's May 31, 1991 letter. For that reason, I do <br />not think this subdivision should be reconsidered with <br />the above analysis in mind. I do think we should <br />develop a plan for establishing standards applicable <br />
