A <br />second plat could be submitted to divide one of the 10 -acre <br />lots into (2) 5 -acre lots. <br />The latter option is generally used since it is much quicker <br />and much less costly to record two exempt plats, than to go <br />through the subdivision review process, and the lots would <br />be subject to restricions which would otherwise not apply. <br />Example 2: <br />A property owner wishes to divide a 50 -acre tract to create <br />(1) 5 -acre lot and (1) 45 -acre lot. The 45 -acre lot is <br />again subject to all subdivision regulations since a 5 -acre <br />lot is being shown on the same plat. Again, if a private <br />road were proposed, the 45 -acre lot would be subject to <br />restrictions on further subdivision. <br />There are many other scenarios which arise, but the examples <br />given represent the following fundamental issues: <br />1) Whether or not subdivision standards apply to lots <br />which are 10 acres or more in size depends solely on <br />how the lots are created. <br />2) The standards contained within the Subdivision <br />Regulations are geared towards lots smaller than 10 <br />acres, and many are inappropriate for lots greater than <br />10 acres. <br />The proposed amendment would specify the regulations which are <br />appropriate for 10+ -acre lots. Other standards would not be <br />applied. This would eliminate the need to record multiple plats <br />to achieve the same end. <br />The specific standards proposed to apply to 10 -acre lots are <br />listed in Section IV -D (new) of the attached amendment. <br />III 78 Classification of Subdivisions <br />All subdivisions shall be considered major subdivisions <br />except those defined as minor subdivisions in this <br />Section. <br />A "minor subdivision" is defined as the division of a <br />tract of land that does not: <br />(1) Create more than five ( 5 ) lots E <br />%' }<< .
