Under current ordinance provisions any change in the operation of a large day care home will constitute a modification and require approval of the Board of Adjustment. The proposed amendment would provide a process where minor changes in approved large day care homes may be approved by the Zoning Officer. The standards for evaluation of large day care homes are specified in Section 6.27.2 of the Zoning Ordinance. In many cases minor changes may continue to comply with these specific standards. The proposed amendment would allow minor changes that comply with requirements in the Zoning Ordinance to be approved by the Zoning Officer. All changes that do not comply with large day care home requirements will require approval of the Orange County Board of Adjustment. RECOMMENDATION: Article 20.5 of the Zoning Ordinance requires that the Zoning Officer prepare a recommendation for consideration by the Board of Commissioners and the Planning Board. This is done at the quarterly public hearing. There is no time limit within which a proposed amendment must be heard.
