The following protections against displacement must be <br />adhered to by the employer: <br />1. The placement of JOBS participants in OJT cannot displace <br />persons who are currently employed or cause their hours, <br />wages, or employment benefits to be reduced; <br />2. The placement of JOBS participants in OJT must not infringe in <br />any way with the promotional opportunities of persons <br />currently in jobs that are not funded by the JOBS. Program; <br />3. The placement of a JOBS participant must not impair existing <br />contracts for services or collective bargaining agreements; <br />4. The placement of a a JOBS participant must not result in <br />filling a position whesi a regular employee has been laid off <br />from the same or substantially the same job. In addition, the <br />employer must not reduce its workforce with the intention of <br />filling the vacancy with an OJT participant; and <br />S. A grievance procedure must be available for regular employees <br />who believe that the placement of a JOBS participant has <br />resulted in their displacement- -refer to Section IV: Program <br />Participation Requirements. <br />Expenses required for participation in approved OJT are paid by the JOBS <br />Program when not otherwise available. If funds are not available to <br />support participation in the component, the activity can not be approved <br />for the ftyloyability Plan. Allowable costs are those expenses <br />specifically related to participation in OJT, i.e• the expense is unique <br />to the component and is required as a condition of participation in the <br />component. Facamples of allowable expenses include, but are not limited <br />to, the employer subsidy, tools, uniforms, shoes and medical exams. <br />(Refer to Section XVI: Participation Expenses for information on <br />non - component specific participation expenses.) <br />1• When determining the appropriateness of placing a participant in <br />A specific job, consider the questions: <br />XIV -5 <br />
