2 <br />main must be installed within the NCDOT right-of-ways for <br />US 70 and Old NC 10 or permanent utx ity e�sements <br />and temporary construction easements must be acquired from <br />property owners between Durham's system and the mobile home <br />park. DOT does not allow privately owned sewer lines to be <br />installed within public roadway right -of -ways, and the <br />private property owners are apparently asking for large <br />sums of money for the required easements. On behalf of the <br />mobile home park owners, the consulting engineers have <br />petitioned Orange County to accept ownership of the <br />proposed force main so that NCDOT will allow the force main <br />to be installed within the right -of -ways. <br />RECOMMENDATION: The Manager recommends that the County decline to <br />accept ownership or maintenance responsibility for the <br />Proposed force main, at least until all of the <br />following conditions have been met: <br />1) NCDOT absolutely and finally refuses to allow the <br />line to be installed within the right -of -ways with <br />County ownership. <br />2) The mobile home park owners prove that they cannot <br />purchase sewer easements from the owners of <br />properties which would be impacted by the necessary <br />easements at any price. <br />3) DEM indicates that they will not allow any other <br />waste treatment option other than pumping waste to <br />the Durham system. <br />4) The BOCC makes a determination that the continued <br />operation of Duke Forrest Mobile Home Park <br />contributes to the public health. safety or welfare. <br />
