65 <br />GiC i <br />G G� <br />� V previously used by Durham County which led to a <br />lawsuit against them resulting in a settlement in <br />excess of $100,000.00. <br />The proposed amendment would provide more <br />explicit information regarding the issuance of <br />septic system permits. <br />(A copy of the proposed amendment is an <br />attachment to these minutes on pages .) <br />Board members expressed concern with the wording <br />"tentatively designated for septic installation <br />and repair. Scott was concerned that it limited <br />the County's liability but, at the same time, did <br />not provide protection or certification for the <br />citizen /applicant. Eidenier responded in <br />agreement that the liability is on the seller and <br />purchaser of the land rather than the County. <br />Scott continued expressing concern that the <br />County should accept more responsibility. <br />Collins explained that at the time of subdivision <br />approval, the Environmental Health Division is <br />testifying that there is a suitable soil area <br />large enough to accommodate a three bedroom <br />house. A guarantee is not provided until the <br />applicant submits house plans and the actual <br />percolation test is done. Then the applicant may <br />be approved for more than three bedrooms. <br />AGENDA ITEM #11: PLANNING BOARD ITEMS <br />a. Hillsborough Cooperative Planning Agreement <br />Eidenier informed the Board that the agreement has <br />been approved by Hillsborough and the County <br />Commissioners. There will be a series of meetings <br />v <br />beginning in January, 1992, to implement the Plan. <br />Meeting adjourned 10:20 p.m. <br />
