�6 <br />Section 6.16.6.1 lists standards for home occupations in areas where <br />highest residential densities are Rermitted. The section applies <br />to all districts where residential uses are allowed, except it does <br />not include the three lowest density zoning districts, namely: RB <br />(Rural Buffer), AR (Agricultural Residential), and R -1 (Rural <br />Residential). This section sets forth the most stringent home <br />occupation restrictions in the ordinance. All activities must be <br />conducted totally within residences and are limited to no more than <br />35 percent or 500 square feet of the total floor area of the resi- <br />dence, whichever is less. No external evidence of occupations may <br />be visible, although one sign is allowed which may not exceed two <br />square feet. Only one person not residing in the home may work in <br />the occupation. <br />Section 6.16.6.2 applies only to Rroperties in the RB AR and R -1 <br />districts with less than 200,000 square feet (4.59 acres). Up to <br />1,000 square feet may be used for home occupations either in homes <br />or accessory buildings with up to 500 square feet allowed for <br />outside storage. Accessory structures, storage areas, and off - <br />street parking must be screened from view from adjacent properties. <br />One home occupation sign of no more than four square feet is allowed <br />in the RA and R -1 districts, or one sign of no more than two square <br />feet is allowed in the RB district. No more than two individuals <br />not residing in the home may work in the occupation. <br />Section 6.16.6.3 generally duplicates the provisions of Section <br />6.16.6.2., but applies only to properties in the RB AR and R -1 <br />districts in excess of 200,000 square feet .,.,(4.59-acres) . Provisions <br />in this section that differ with those in 6.16.6.2 allow: (1) a <br />maximum of 2,000 square feet of floor area for use either in a home <br />or respective accessory structure; and (2) a maximum of 1,000 square <br />feet for outside storage. Two additional provisions require acces- <br />sory buildings to be set back at least 30 feet farther from the road <br />and 40 feet from side and rear lot lines. <br />Section 6.16.6.4 describes the aipRlication procedures for attaining <br />home occupation permits. Applications are handled administratively <br />by the Zoning Officer. Application details depend on particulars <br />of proposed home occupations and the districts in which they are <br />located. Site plans, and residence or accessory structure floor <br />plans, are required. Appeals to the decisions of the Zoning Officer <br />may be directed to the Board of Adjustment. <br />Amendment Issues <br />Article 22 DEFINITIONS uses the term "accessory use" to define a <br />home occupation. This is confusing. The term "accessory use" <br />should be removed from the definition. It is recommended that the <br />definition be rewritten to reflect better the nature of home occupa- <br />tions. <br />
