Mr. Eddie Kirk <br />October 7, 1991 <br />Page Three <br />treatment plant shall be included as part of the Planned Development <br />with access from Mount Hermon Church Road." Nothing has changed with <br />regards to this condition. Mrs. Bane will have a private wastewater <br />treatment plant with access from Mt. Herman Church Road. Only the <br />form of the plant has changed and the spray irrigation system is in <br />any event preferable because there will be no discharge into the <br />waters of North Carolina so that the only affected party will be the <br />owner of the land, Mrs. Bane. <br />Condition 23 stated that "the development shall be built and <br />operated according to the site plan and written narrative supplied by <br />the developer . . . 11. As stated above, Mrs. Bane fully intends to <br />follow the original Site Plan submitted in 1982 as subsequently <br />revised in consultation with your office. The "narrative" apparently <br />refers to a document filed with the County Commissioners as part of <br />the application for the Special Use Permit. The document states that <br />sewer will be provided by private package plant; sewer is still being <br />disposed of by package treatment plant. The only difference is that <br />the treated effluent that comes out of the package plant is being <br />sprayed on a field rather than dumped in a creek. <br />As for Section 8.7.1(j) of the Zoning Ordinance, we contend that <br />there has been no "change in the location or extent of . sewer . <br />. facilities . . . which would provide a different level of service" <br />so as to constitute a change. The type of facility has changed but <br />the level of service will remain the same, all mobile homes will be <br />provided with ample sewage removal capacity. The only difference is <br />that the sewage effluent will be sprayed on a field instead of <br />discharged into a stream. Such a change does not at all affect the <br />level of service which will be provided to the Stonegate Mobile Home <br />Park. <br />The change in the sewer system is clearly within the category of <br />minor change and should not be treated as a modification which would <br />required Mrs. Bane to resubmit an application for the Special Use <br />Permit. <br />Nonetheless, we have attempted to comply with Section 8.7.3 by <br />filing this Application for Modification of the Special Use Permit. <br />Section 8.7.3 requires that an applicant for modification submit a <br />revised Site Plan and written narrative outlining the specific changes <br />required. These documents as set forth above are enclosed. <br />There appears to be some confusion as to the need for a separate <br />Special Use Permit for the wastewater treatment site. Condition 18 of <br />the Special Use Permit also explicitly states that the private <br />wastewater treatment plant "shall be included as part of the Planned <br />Development ". Therefore, we question the necessity of a new Special <br />Use Permit for the spray irrigation field where no such permit would <br />
