3 <br />RESOLUTION OF COMMENT TO THE NORTH CAROLINA ENVIRONMENTAL <br />MANAGEMENT COMMISSION ON PROPOSED CLASSIFICATIONS AND RULES FOR <br />WATER SUPPLY WATERSHEDS <br />WHEREAS, the Board of Commissioners of Orange County have <br />considered the proposed state minimum rules for water supply <br />watersheds in North Carolina; and <br />WHEREAS, Orange County has long been an advocate of protection of <br />our critical water resources; and <br />WHEREAS, Orange County contains part or all of 11 water supply <br />watersheds that would be protected under this program, and <br />WHEREAS, the Board of Commissioners is in general agreement with <br />the concept and program of statewide protection of all water <br />supplies; and <br />WHEREAS, Orange County has held public hearings on the state <br />minimum rules and classifications to receive citizen comment; and <br />WHEREAS, the Board of Commissioners have received recommendations <br />from the Orange County Planning Board and Orange County <br />Administration; <br />NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners <br />that the Board requests the Environmental Management Commission <br />to: <br />1. Persevere with adopting a statewide program of water supply <br />watershed protection. <br />2. Adopt changes to the classifications and rules as spelled <br />out in the attached Position Statement for Orange <br />County. Requested changes in classification are summarized <br />as follows: <br />a. Change the proposed classification of the Back Creek <br />and South Hyco Creek watersheds to WS -III. <br />b. Designate University Lake Watershed as a "Critical <br />Watershed" under the provisions of 15 NCAC2B .0104 (k). <br />C. Change the proposed Eno River classification by <br />splitting the basin into three sub - basins, to more <br />accurately reflect the different character and nature <br />of these sub - areas. The specifics of this proposed <br />classification change are spelled out in the Position <br />Statement. <br />5. Exempt existing farms from the provisions of agricultural <br />buffers, endorsing instead the Agricultural Cost -Share <br />Program as an alternate protection measure. <br />
