K <br />• ask the Commission to reconsider its decision and permit polling <br />Of CENTEL and Mebane Home Customers - more than 2,000 customers <br />have signed petitions supporting Orange County EAS <br />• ask the Commission to re- evaluate Mebane Home's claim of "severe <br />financial distress" <br />• the Commission directed splitting of the Mebane exchange during <br />the 1988 Triangle J rate study - it is inappropriate to <br />criticize the orange County EAS proposal for following this <br />direction <br />* Orange County continues to support the 50% toll discount plan <br />between orange and wake Counties <br />* the Orange County EAS proposal could reasonably proceed <br />simultaneously with the intercounty experimental plan <br />The County can also appeal to the North Carolina Court of Appeals, <br />seeking reversal of the Utility Commission decision. The County <br />Attorney has been researching the County's requirements in the appeal <br />process and will report further on them at this Board meeting. <br />The County's third option lies in seeking legislative reform. This <br />could be pursued either through statewide legislation or a local act in <br />the General Assembly. A principal objective would be creation of a <br />guaranteed process to permit telephone customers the right to be polled <br />on EAS. <br />The Public Staff may also choose to pursue the first two options on <br />behalf of the using and consuming public. If it does so, the County <br />may choose to join the Public Staff in this effort. <br />The Board of Commissioners may also want to consider holding a public <br />hearing within the next month or two to demonstrate to the Utility <br />Commission the broad -based support for Orange County EAS. <br />RECOMMENDATION(S): The Manager recommends: that the Board authorize <br />the Chair to file a request for reconsideration, to give notice of <br />appeal, and to join with the Utility Commission Public Staff, should it <br />elect to pursue reconsideration or appeal of the Utility Commission <br />decision; and that the request for reconsideration or appeal <br />incorporate the points listed above, subject to final review by the <br />County Attorney. <br />
