MOTION: <br />VOTE: <br />MOTION: <br />%I <br />Jobsis moved to delete the phrase "except <br />through cost -share program from the proposed <br />agricultural buffers. Seconded by Hoecke. <br />Unanimous. <br />Eidenier moved approval of the State WS -II <br />classification for South Hyco Lake. Seconded by <br />Cantrell. <br />VOTE: Unanimous. <br />MOTION: Cantrell moved to approve the Planning Staff's <br />recommendation with the exception of the two <br />previous motions. Seconded by Hoecke. <br />VOTE: 8 in favor. <br />1 opposed (Waddell- opposed to University Lake as <br />Critical Watershed). <br />b. Subdivision Regulations Text Amendments <br />0 ( 1 ) Section IV- B- 7--b -6 <br />Payments in Lieu of Dedication <br />Presentation by Emily Cameron. <br />The North Carolina General Statutes Chapter 153A- <br />331(a) describes the contents and requirements of <br />a county's subdivision control ordinance. <br />Effective June 10, 1991, this Section, as <br />applicable to Orange County, was amended to allow <br />the County to develop recreation areas using <br />funds received from subdividers who make payments <br />in lieu of dedicating land for recreation. <br />Previously, the County could only acquire lard <br />with payment -in -lieu funds, but not develop the <br />recreation area with monies from the same source. <br />The proposed amendment to Section IV- B -7 -b -6 wi::1 <br />include development of recreation areas as a use <br />for funds received from payments made in lieu o_` <br />dedication. <br />The proposed amendment was presented at public <br />hearing on August 26, 1991 and no citizen <br />comments were received. <br />The Planning Staff recommends approval of the <br />proposed amendment. <br />MOTION: Cantrell moved approval as recommended by the <br />Planning Staff. Seconded by Burklin. <br />
