_. <br />K <br />____The proposed amendment to Section IV- B -7 -b -6 will <br />include development of recreation areas as a use for <br />funds received from payments made in lieu of dedica- <br />tion. <br />During preliminary review of the proposed amendment, <br />the question was raised by the Planning Board as to <br />whether money generated from the sale of land <br />dedicated for recreation purposes could also be used <br />for development of recreation areas (refer to the last <br />sentence of Section IV- B- 7 -b -6). The Subdivision <br />Regulations state, "The Board of Commissioners shall <br />also have the authority to sell land dedicated <br />pursuant to these provisions with the proceeds of any <br />such sale used solely for the acquisition of other <br />recreation, park or open space sites within the <br />immediate neighborhood within which the development is <br />located." The change in the General Statutes does not <br />affect this provision since the legislation refers <br />specifically to the use of payments made in lieu of <br />dedication, not to the use of money gained from the <br />sale of County -owned lands. <br />The proposed amendment was presented at public hearing <br />on August 26, 1991. No citizen comments were received. <br />During discussion of the proposed amendment on <br />September 16, the Planning Board requested the <br />following information on the amount of payments <br />received to date per recreation service area. The <br />table includes all major subdivisions approved since <br />August 4, 1986, and all minor subdivisions approved <br />since May 16, 1989. The totals are current as of <br />September 5, 1991.
