Effective June <br />10, 1991, this Section, as applicable to Orange <br />County, was amended to allow the County to develop <br />recreation areas using funds received from subdividers <br />who make payments in lieu of dedicating land for <br />recreation. Previously, the County could only acquire <br />land with payment -in -lieu funds, but not develop the <br />recreation area with monies from the same source. <br />The amendment to the General Statutes was requested to <br />allow the County to use payment -in --lieu money in the <br />same way that municipalities use that money in their <br />jurisdictions. The state enabling legislation <br />previously empowered cities and towns to acquire and <br />develop recreation areas with payments made in lieu of <br />land dedications, but equal power was not extended to <br />counties in the General Statutes. As of June 10, 1991, <br />Orange County obtained the same rights as municipali- <br />ties with regard to the use of payment -in -lieu funds. <br />
