R <br />Clayton Case (9116 ) Summary <br />Location: Clayton's Body Shop, 1404 Buckhorn Road <br />violation: Commercial use (a body shop and junked motor <br />vehicle storage) of property zoned Rural <br />Residential (R -1), beyond a commercial zoning <br />lot. The outside storage of junked motor <br />vehicles is not permitted in the R -1 dis- <br />trict. <br />Background: Claytons Body Shop is located on a 200' X <br />200' commercial zoning lot (Existing Commer- <br />cial EC -5), which is situated on a 5.12 -acre <br />parcel. A number of anonymous neighbors have <br />complained about junked motor vehicles being <br />moved and stored beyond the zoning lot lim- <br />its. It is estimated that the area used ille- <br />gally in the R -1 portion of the parcel is 3- <br />4 times larger than the EC -5 zoning lot. <br />A number of conversations about the zoning <br />violations going back to November 1990 have <br />been held with Mr. Clayton. He made promises <br />to rectify the violation, but there has been <br />little or no action on his part. with no <br />action forthcoming, a letter was sent on May <br />28, 1991, stating that the property was to <br />have been brought into compliance on or be- <br />fore July 1, 1991. <br />At the end of June 1991, Mr. Clayton's father <br />came to the Planning and Inspections Depart- <br />ment to report that his son was burned in an <br />accident. Clayton was hospitalized at Duke <br />Medical Center for over a month. The dead- <br />line to remove the junked motor vehicles on <br />the R -1 land was temporarily lifted by the <br />Zoning officer. <br />On August 5, 1991, Mr. Clayton was back on <br />the job. He promised on that day that he <br />would begin moving vehicles to correct the <br />violation. For the second time he was given <br />the names of a number of contractors who <br />would buy the vehicles for him. <br />Status: To this date (September 26, 1991), there has <br />been no perceivable evidence of activities <br />toward correcting the violation. <br />Filing Date: November 19, 1990 <br />Date civil Penalties Began: September 3, 1991 <br />Accumulated Civil.Penalties as of September 26, 1991: $2,300 <br />
