County Commissioners, City Council and Town Council <br />October 8, 1991, Page 2 <br />Even though most of the Corridor is in Durham County, this is greatly <br />disproportionate because the residents of Chapel Hill and Orange <br />County will derive and enjoy at least equal benefits from the Plan <br />along with the residents of Durham and Durham County. We submit that <br />the implementation costs should also be allocated and shared at least <br />equally. We urge the governing bodies to develop an equitable <br />allocation of the implementation costs prior to taking action on the <br />Plan. <br />2. The costs to acquire the Wildlife Protection Area and <br />development rights on adjacent lands as shown on Plan Tables 1 & 2, <br />Pages 63 &164, appear to be seriously underestimated when compared to <br />acquisition costs for the land in several of the developments and <br />subdivisions to the south, east and northeast of the Property. Thus, <br />the total estimated costs of implementing the Plan may be seriously <br />underestimated and before any action is taken on the Plan such costs <br />should be estimated with greater certainty. <br />3. The portion of the property in Durham County is presently <br />zoned R -20 and all development in the immediate area and to the south, <br />east and northeast of the Property for several miles has been <br />developed consistent with this medium density residential zoning. <br />Further, the long range land use plans which have been adopted thus <br />far endorse the development in this area consistent with such zoning. <br />We will oppose a zoning change from R -20 to Rural Buffer (or similar <br />zone of less density) as such zone change is inconsistent with the <br />development in the area and as endorsed by all long range plans. <br />4. The timetable for Plan implementation, for all practical <br />purposes, will cloud, inhibit, and restrict the use and value of our <br />property and we oppose this implementation schedule. <br />The Branch Estate heirs and owners of Mortgage & Realty <br />Associates„ Inc., in addition to the concerns and opppQsition <br />expressed above, convey a willingness to investigate mutually <br />beneficial solutions to the concerns expressed above. This is in <br />keeping with the Plan recommendation to the various governing bodies. <br />In the meantime, as we expressed above, we will oppose specific <br />portions of the Plan which will adversely affect the Property and our <br />rights as owners. <br />Sincerely, <br />L4 �s <br />Dr. Dallas D.
