Ronald Aycock, Executive Director <br />JoAnne Spell, Staff Counsel <br />DATE: August 22, 1991 <br />SUBJECT: Vested Rights <br />During the 1990 short session, the General Assembly ratified Senate <br />Bill 766 - Vested Rights. This complicated law, most of which is <br />codified at G.S. 153A -344.1 (for counties) and G.S. 160A -385.1 (for <br />cities), has an effective date of October 1, 1991. The bill also <br />contemplates the adoption Of a local ordinance implementing the law <br />effective that same date. <br />Enclosed is an analysis of the law and a copy of a model ordinance <br />drafted by the League of Municipalities and modified for county <br />application. A copy of the relevant portions of Senate Bill 766 is <br />also enclosed.
