ORANGE COUNTY PLANNING DEPARTMENT 12 <br />306F REVERE ROAD <br />HILLSBOROUGH, NORTH CAROLINA 27278 <br />i31 <br />M E M O R A N D U M <br />To: John Link, County Manager <br />Marvin Collins, Planning Director <br />Geoffrey Gledhill, County Attorney <br />FROM: Mary Scearbo, Planner III <br />DATE: August 23, 1991 <br />SUBJECT: Vested Rights <br />A memorandum dated August 22, 1991 regarding Vested Rights was sent <br />to "Managers, Attorneys, and Planning Directors" by the N.C. <br />Association of County Commissioners. <br />Enclosed was an analysis of Senate Bill 766 (effective date October <br />1, 1991) and a copy of a Model Ordinance drafted by the League of <br />Municipalities and modified for application to counties. <br />An amendment to the Subdivision Regulations and Zoning Ordinance to <br />incorporate the provisions of Senate Bill 766 will be presented at <br />the public hearing on Monday, August 26. <br />In comparing the model ordinance, and the proposed amendments, I <br />found that the provisions included in the model ordinance are, for <br />the most part, covered in the proposal, though the arrangement is <br />different. <br />The model ordinance does contain the following concepts, which are <br />not in the proposed amendment: <br />1) Specifying that a variance is not a Site Specific Development <br />Plan. <br />2) Notation on vested site plan, plat, etc.: <br />"Approval of this plan establishes a zoning vested right under <br />GS 153A- 344.1.
