An application for an amendment <br />or._mgdification to an approved Site Specific Development Plan <br />shall_ be treated _as anew ag lication. <br />Once established, a vested right supersedes any zoning action <br />whic ould of ect with the ty2e and intensity of use <br />aRRroved in the e S ecific Development Plan EXCEPT: <br />a) upon written consent of the landowner; <br />b) upon findings after a pgbalic hearing, that if the <br />development were to proceeds natural or man- made_hazards <br />would pose a serious threat to the public health, safety <br />and welfare4 <br />c.) to the extent that the landowner is compensated for costs <br />and expenses other than loss at-property_yalue; <br />d) upon findings, after a public hearing, that the applicant <br />,hisJher rgnresgntative(s_ intentionally_ sut� plied <br />inaccurate or misleading information which led to the <br />aa22roval of the project; or <br />e) upon findings, after a public hearing, that a change in a <br />State or Federal law or___recrulation_precludes_ development <br />of the project as approved. <br />Vesting of rights does not Rreclude the application of <br />overlay zoning d'stricts which impose additional regulations, <br />provided that the reaulations are applicable to all property <br />subject to this Ordinance and the allowable t e and <br />intensity of use is not affected <br />The vested right terminates at the end of the approved <br />vesting period_for buildings and uses for which building <br />permits have not been issued. Building permits do not expire <br />durin -m the approved vesting period. <br />ARTICLE 14.3 - SITS PLAN REVIEW <br />14.3.2 Where an application is found to be inconsistent <br />with the above criteria, Staff may recommend changes <br />to the site plan. <br />Following review of the site plan, except as <br />provided by Article 14.3.3 of this Ordinance, the <br />Planning and Inspections Department will take final <br />action on the application within 21 days of <br />acceptance.
